With the modernist and post modernist approaches in sociology taking root, the theory of feminism began to emerge and develop into a formidable challenge to the existing paradigms of gender roles and rights. Feminism is the school of thought that aims to seek recognition of women in their own right rather than as an extension to men's existence. Since feminism achieves its objective by challenging the privileged position of men, its arguments are based upon two doctrines of equality, through which they argue equal status for both genders. The two doctrines, through which feminism argues equality for both sexes, are "legal equality doctrine" and "fairness doctrine".

Through the legal equality doctrine, the feminists assert that path to equality is based on changing the paradigm of natural difference and its political consequences. They aimed to assert the rational thought, denying any fundamental difference in character or nature between sexes, and instead asserting that differences were societal and legal. For instance in the legal institution of marriage, feminists argued that there was legal subjugation of one sex to the other and not biological. Furthermore, the laws around pregnancy and workplace assumed that women were unequal and inferior to men because of their physical structure. On the other hand, the legal equality doctrine asserted that any laws surrounding pregnancy and workplace should not take gender as basis and that pregnancy be deemed a temporary disability since the concept of separate legislations for working men and women in event of pregnancy was incompatible with ...
