The Amistad case was a significant point in 19th Century American history because the Supreme Court of the Untied States determined that kidnapped African Americans were in fact people with the right to life, liberty, and the pursuit of happiness. In February 1839, African Americans were kidnapped from their homeland in Africa by Portuguese slave hunters. These African Americans were sold into slavery in Cuba, and then taken to the United States on a ship called the Amistad. On their way to the United States the African tribal leader, Cinque, leads a revolt and takes over the ship. they had to eat out of their hands. Sick people were not given food since there wasn’t enough food to go around for the whole trip. Since there weren’t enough resources some of the African had to be killed. They were chained up and thrown off the boat. Some of the kidnapped Africans weren’t able to take it anymore, and they would jump off the boat on their own free will.
During the trial, the defense argued that the Africans could not be sold as property and it also defended them against murder and the harsh conditions on the ship. The defense said that since they were once free citizens of one country that they should also be free anywhere else. The prosecution argued that they are property and that they should be given back to their owners. They also complained about the Africans killing the crew members and said that they tried taking over the ship.
